ContentSpark Terms of Service

These Terms of Service ("Terms") govern your access to and use of ContentSpark (the "Service"). By accessing or using ContentSpark, you agree to these Terms. If you do not agree, do not use the Service.
1. What ContentSpark Is
ContentSpark is an AI-powered content repurposing application that may include, among other things:
- content generation and rewriting tools
- repurposing for channels such as LinkedIn, X / Twitter, email, Instagram, or similar platforms
- saved history and account-based access
- premium or subscription-based features
ContentSpark is an informational and productivity software product. It is not legal advice, marketing advice, or a guaranteed source of publishing, growth, or business outcomes.
2. Eligibility and Accounts
To use the Service, you must:
- be at least 18 years old, or the age of majority in your jurisdiction
- provide accurate registration information
- keep your account credentials secure
- be responsible for all activity that occurs under your account
You are responsible for maintaining the confidentiality of your account and for restricting access to your devices.
3. AI Output and No Guarantees
ContentSpark uses AI and automated systems to generate rewritten, summarized, or repurposed content. You acknowledge and agree that:
- generated outputs may be inaccurate, incomplete, repetitive, stale, or unsuitable for your use case
- outputs may require human review, editing, fact-checking, and brand review before publishing
- we do not guarantee originality, legal compliance, platform compliance, or business performance
- you are solely responsible for reviewing and deciding whether to use generated outputs
4. Your Content
You retain ownership of the content, source material, prompts, and text you submit to the Service, subject to any rights necessary for us to operate the Service.
You grant ContentSpark a limited right to store, process, and use that material as necessary to provide, maintain, secure, and improve the Service.
You are solely responsible for:
- the text and materials you submit
- ensuring you have the right to use and process that material
- reviewing generated outputs before publishing or distributing them
- complying with applicable laws, platform rules, and third-party rights
5. Acceptable Use
You agree not to:
- use the Service for unlawful purposes
- submit content you do not have the right to use
- interfere with or disrupt the Service
- attempt unauthorized access to accounts, systems, or data
- scrape, overload, or abuse the Service beyond normal intended use
- reverse engineer or bypass technical protections except as allowed by law
- use the Service to generate unlawful, abusive, or harmful material
We may suspend or terminate access for abuse, security concerns, or misuse.
6. Third-Party Services
ContentSpark depends on third-party services, which may include providers for:
- authentication
- hosting and databases
- AI generation/model providers
- payments
Your use of certain features may also be subject to the terms or policies of those third parties. We are not responsible for failures, downtime, policy changes, bans, or data issues caused by third-party providers.
7. Payments and Subscriptions
Some features may require a paid subscription. If you purchase a subscription:
- billing may be processed by a third-party payment processor such as Stripe
- you authorize recurring charges if you enroll in a recurring plan
- pricing, billing intervals, and included features may change prospectively
- cancellation stops future renewals but does not retroactively refund already billed periods unless required by law or expressly offered
If payment fails, we may limit or suspend premium access.
8. Beta / Early Access Status
ContentSpark may be offered in beta, early access, limited release, or otherwise unfinished form. In that case, you understand that:
- features may be incomplete
- functionality may change materially without notice
- stability and uptime may be lower than a fully mature service
9. Intellectual Property
The Service, including its software, design, branding, copy, and underlying systems, is owned by ContentSpark or its licensors, except for third-party materials and user-provided content. These Terms do not grant you ownership of the Service or any intellectual property rights beyond the limited right to use the Service in accordance with these Terms.
10. Privacy
Your use of the Service is also subject to the ContentSpark Privacy Policy.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE"WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR AVAILABILITY.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTENTSPARK AND ITS OPERATORS, AFFILIATES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, OR OTHER LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
If liability cannot be excluded, our total liability for any claim arising from or related to the Service will be limited to the amount you paid to ContentSpark in the 12 months before the claim arose, or EUR 100, whichever is greater.
13. Indemnity
You agree to indemnify and hold harmless ContentSpark and its operators from claims, liabilities, damages, losses, and expenses arising out of:
- your misuse of the Service
- your violation of these Terms
- your violation of law or third-party rights
- your submitted content or your use of generated outputs
14. Suspension and Termination
We may suspend or terminate your access at any time, with or without notice, if:
- you violate these Terms
- your use creates security, legal, or operational risk
- required third-party services become unavailable
- we discontinue the Service or a feature
You may stop using the Service at any time.
15. Changes to the Service or Terms
We may modify the Service, pricing, features, or these Terms from time to time. If we make material changes, we may provide notice in-app, by email, or by updating the effective date. Your continued use after changes take effect means you accept the updated Terms.
16. Governing Law and Venue
These Terms are governed by the laws applicable in the operator's principal jurisdiction, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the competent courts of that jurisdiction, unless mandatory law requires otherwise.
